đĄ Luxe Buyer & Seller Guide: Understanding Agency and Non-Agency Relationships
Presented by Luxe International Homes & Properties â Serving South Georgia, Metro Atlanta & Beyond
When you're buying or selling a home, one of the most important decisions youâll make isnât just about the property â itâs about who is representing you. At Luxe International Homes, we believe in transparency, education, and helping our clients understand their options fully.
Letâs walk through what it means to have an agency or non-agency relationship with your real estate professional, and how to decide whatâs best for your situation.
đ¤ What Does It Mean for a Real Estate Professional to Be My "Agent"?
When you hire a licensed real estate professional to represent you in a transaction, they become your agent. This relationship is typically defined by a written agreement and comes with fiduciary duties â meaning the agent is legally bound to act in your best interests.
A sellerâs agent works to get the best possible price and terms for the seller.
A buyerâs agent protects the buyerâs interests throughout the home search, offer, and negotiation process.
As part of recent changes in industry standards, many buyerâs agents (especially those who are REALTORSÂŽ) may now require a written buyer agreement before touring homes.
đˇď¸ What Are the Different Types of Agency Relationships?
Agency relationships can vary, and not all are allowed in every state. Here's a quick breakdown:
1. Single Agency
One agent represents only one party in the transaction â either the buyer or the seller. This is the most straightforward form of representation.
2. Dual Agency
In states where it's allowed, one agent can represent both buyer and seller. Because this creates potential for conflicts of interest, dual agency requires full disclosure and informed consent from both parties.
3. Subagency
Here, an agent works with the sellerâs agent to bring in buyers. A subagent also owes full loyalty to the seller, meaning they canât help the buyer in any way that might hurt the sellerâs interests.
States that allow subagency often require:
Seller authorization
Disclosure to the buyer
4. Designated Agency
In this model, agents from the same real estate brokerage represent both buyer and seller â but different agents are assigned to each party. This minimizes conflict and maintains client loyalty, as long as:
Disclosure is made
Both parties consent
At Luxe, if designated agency applies, we ensure all parties are fully informed and supported.
âď¸ Is It Possible to Have a Non-Agency Relationship?
Yes.
In a non-agency relationship, the real estate professional is not representing either party's best interests but may still help facilitate the transaction.
One common example is a transaction broker (or facilitator), who acts as a neutral party, helping both sides come to an agreement without advocating for either.
This option may work in very specific cases, but Luxe always prioritizes representation and protection for our clients whenever allowed by law.
đ Do I Have to Enter Into an Agency Relationship?
Not necessarily.
Your relationship with a real estate professional can be:
Agency
Non-agency
Or any hybrid permitted by your state law
However, if you work with a buyerâs agent, they may now require a written agreement prior to home tours â part of new best practices in the industry.
