🤝 What Does It Mean for a Real Estate Professional to Be My "Agent"?

When you hire a licensed real estate professional to represent you in a transaction, they become your agent. This relationship is typically defined by a written agreement and comes with fiduciary duties — meaning the agent is legally bound to act in your best interests.

  • A seller’s agent works to get the best possible price and terms for the seller.

  • A buyer’s agent protects the buyer’s interests throughout the home search, offer, and negotiation process.

As part of recent changes in industry standards, many buyer’s agents (especially those who are REALTORS®) may now require a written buyer agreement before touring homes.

🏷️ What Are the Different Types of Agency Relationships?

Agency relationships can vary, and not all are allowed in every state. Here's a quick breakdown:

1. Single Agency

One agent represents only one party in the transaction — either the buyer or the seller. This is the most straightforward form of representation.

2. Dual Agency

In states where it's allowed, one agent can represent both buyer and seller. Because this creates potential for conflicts of interest, dual agency requires full disclosure and informed consent from both parties.

3. Subagency

Here, an agent works with the seller’s agent to bring in buyers. A subagent also owes full loyalty to the seller, meaning they can’t help the buyer in any way that might hurt the seller’s interests.

States that allow subagency often require:

  • Seller authorization

  • Disclosure to the buyer

4. Designated Agency

In this model, agents from the same real estate brokerage represent both buyer and seller — but different agents are assigned to each party. This minimizes conflict and maintains client loyalty, as long as:

  • Disclosure is made

  • Both parties consent

Not necessarily.

Your relationship with a real estate professional can be:

  • Agency

  • Non-agency

  • Or any hybrid permitted by your state law
